Terms and Conditions

Article 1 – Introduction

These General Terms and Conditions of Sale (hereinafter, the “Terms”) govern the purchase of goods offered by ELFATECH S.r.l. (hereinafter, the “Supplier” or “Elfatech”), with its registered office at 25016 – Ghedi (BS), Via dei Mugnai 2, VAT number and tax code 04413520984, via the website https://elfatechsrl.it (hereinafter, the “Website”).

These Terms and Conditions are intended for Consumer Customers within the meaning of Legislative Decree 206/2005 (“Consumer Code”) and for Professional Customers and Businesses. Any general reference to “Customers” shall be understood to apply to both categories of customers.

By placing an order, the Customer confirms that they have read, understood and accepted these Terms and Conditions in full.

2. Subject matter of the Contract

The subject matter of this contract is the sale by the Supplier of woodworking equipment, spare parts and accessories, as set out in the catalogue on the Website.

The key features of the goods and services are described in detail in the relevant product descriptions available on the Website. The image accompanying a product’s technical description may not accurately reflect its features but may differ, for example, in terms of colour, size, or the accessories shown in the illustration.

3. Purchasing Procedure

The Customer may select the desired products by adding them to the virtual shopping basket and following the purchase procedure set out on the Website. During this process, the Customer may choose the products they wish to purchase and check the total value of the order before proceeding to complete the purchase.

The order must be completed in full and must clearly identify the selected products and the customer’s details:

  • For individuals, you must provide your first name, surname, tax reference number, billing and delivery addresses, as well as your contact details.
  • For legal entities, in addition to the information above, further company details must be provided, such as the company name, VAT number and certified email address.

The Supplier will confirm receipt of the order by email, and such confirmation shall constitute acceptance of the order and the conclusion of the sales contract. However, Elfatech reserves the right to refuse orders in the following cases: unavailability of the Products ordered; incomplete or incorrect details provided by the Customer; suspected fraudulent or irregular activity.

4. Prices and Invoicing

The prices shown on the Website are in euros and include VAT, regardless of whether the Customer is a consumer or a business.

Delivery costs are included in the product price, except for deliveries to islands or remote areas. In such cases, the Customer may request a personalised quote for delivery by contacting the Supplier at info@elfatechsrl.it.

The invoice will be issued using the details provided by the Customer at the time of purchase, and the Customer is responsible for ensuring that these details are correct and complete.

5. Payment methods

5. Payment methods: The Customer may make payments by credit/debit card, bank transfer and/or other payment methods indicated to the Customer at the time of purchase, such as PayPal.

To make a payment by credit card, the Customer will be redirected to the secure server of Stripe Inc., the payment provider chosen by Elfatech and equipped with 3D Secure technology; therefore, all payment-related information (credit card number, expiry date, etc.) will be transmitted directly to the relevant bank. Elfatech accepts the most common credit cards, including prepaid and rechargeable cards: Visa, Mastercard, Postepay, American Express and CB. Upon entering your credit card details, payment will be processed immediately, with the amount debited from your credit card in accordance with the terms and conditions set by the card issuer.

6. Delivery of Products

Elfatech will deliver the Products ordered by the Customer, in accordance with the terms specified in the Purchase Order as confirmed in the Order Confirmation, via trusted couriers and/or freight forwarders within Italy. The various delivery methods, times and costs correspond to those indicated on the Website and accepted by the Customer during the purchase process upon submission of the Purchase Order. Shipping costs, as well as VAT, are included in the product price shown both in the “Products” section and in the virtual shopping basket. However, Elfatech reserves the right to request an additional payment to cover shipping costs to islands or remote areas. In such cases, the Customer may request a personalised quote by emailing info@elfatechsrl.it.

Delivery will be made to the address provided by the Customer upon completion of the purchase process on the Website. The Customer is required to check that the information entered when placing the Purchase Order is accurate and complete. The delivery method will correspond to the option selected at the time of ordering. The Customer must notify us of any obstacles or special conditions regarding access to the specified address that may hinder or complicate delivery. In pedestrian areas, delivery will be made to the point accessible by vehicle.

Upon receipt of the purchase order, Elfatech shall deliver the Products to the Customer within the specified timeframes. Delivery times may vary depending on the type of product ordered; therefore, the Products are normally expected to arrive at the address provided by the Customer within 4 to 25 days.

7. Right of withdrawal for consumers

Under the Consumer Code (Legislative Decree No. 206/2005), the Consumer Customer has the right to withdraw from the contract within fourteen (14) days of delivery, except in the case of made-to-measure or personalised products, without incurring any penalty and without giving any reason. In this case, the Consumer Customer must return the purchased goods intact, in normal condition, in their original packaging and complete with all accessories, instruction manuals and any other items included in the package. The right of withdrawal may apply to the entire order or only to part of the purchased goods.

To exercise the right of withdrawal, the Consumer Customer must send written notice by email or certified email (PEC), or by using the contact form available on the website.

Unless otherwise agreed, the direct cost of returning the goods shall be borne by the consumer. Elfatech will process the refund within 14 days of receiving the notice of withdrawal, net of any delivery charges.

8. Right of withdrawal for business customers

The Business Customer is entitled to exercise the right of withdrawal in accordance with the provisions of the Civil Code, to which full reference is made.

9. Warranty

The Supplier guarantees the conformity of the goods sold. Consumer Customers who discover any defects must, within the time limits set out in the Consumer Code, notify Elfatech, which, in the event of a lack of conformity, will arrange for repair, replacement free of charge or, where appropriate, a reasonable price reduction, as provided for by current legislation. Elfatech is liable for any lack of conformity (existing at the time of delivery) that becomes apparent within two (2) years of delivery of the goods. Should the Consumer discover a lack of conformity, they must notify the seller within two months of discovery and, in any event, within 26 months of delivery.

For business customers and companies, the warranty terms set out in the contract or in the Italian Civil Code (Articles 1490 et seq.) apply. Should you discover any defects, you must make a claim under the warranty within one (1) year of delivery of the products, and the defects must be reported in writing within 8 days of discovery, unless otherwise agreed.

It is also possible to send a message to Elfatech using the form provided in the “Contact Us” section of the website. Here, the Customer should provide their name, company (if applicable), place of residence or domicile, and the telephone number or email address to which they wish communications to be sent.

11. Processing of Personal Data

The personal data provided by the Customer will be processed in accordance with the applicable data protection legislation (EU Regulation 2016/679 – GDPR). Further information is available in the Privacy Policy and the Cookie Policy, which can be viewed on the website.

12. Governing law and jurisdiction

These General Terms and Conditions are governed by Italian law. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the court in the place of the Customer’s residence or domicile.
